One of the key things we’ve seen in the pushback on CISPA is that its backers insist that people arguing against it don’t really understand how the bill works, and that it does protect privacy. CISPA sponsor Rep. Mike Rogers himself took to Twitter this morning to tell the EFF that it’s misreading his bill. But, of course, as we’ve seen, it seems that Rogers himself is the one being misleading when it comes to privacy. If he truly believed in privacy protections, he would have supported a variety of straightforward amendments that made it clear how privacy could be protected. But he didn’t. Instead, he clearly left it open for abuse.

One of the key points that Rogers keeps saying over and over again is that this bill is not a “surveillance” bill. Why? Because it doesn’t allow the NSA or others to go in and automatically get info. But Rogers is choosing his words very carefully, such that he absolutely misrepresents how the bill can and almost certainly will be used. And while he and other CISPA supporters will (and have) argued that the possible abuses of CISPA are crazy conspiracy theories that wouldn’t happen in practice, we have too many examples of how the US government’s intelligence infrastructure very quickly expands to make use of every single loophole provided to them within the law — sometimes going so far as to interpret laws in ways clearly contrary to Congressional intent, just because they can. Let’s just highlight two examples:

“Now you will discover the definitive truth about 9/11 and learn why even the most popular movies on the subject have failed to address the evidence exhaustively presented in this video. The facts will make it abundantly clear that the so-called 9/11 “Truth” movement has been infiltrated and is ultimately controlled by the same criminal group who masterminded the attacks. As they say, ‘if you want to control the dissent you lead the dissent.’ Utilizing evidence from the FBI, CIA, NSA, US Armed Forces Intelligence sectors, Foreign Intelligence organizations, local law enforcement agencies and independent investigators, Missing Links goes where no other 9/11 video has dared to.”http://www.911missinglinks.com/YOU DECIDE!

Why The NSA Can’t Be Trusted to Run U.S. Cybersecurity Programs

Why The NSA Can’t Be Trusted to Run U.S.

Cybersecurity Programs

This week, the Senate will be voting on a slew of amendments to the newest version of the Senate’s cybersecurity bill. Senators John McCain and Kay Bailey Hutchison have proposed several amendments that would hand the reins of our nation’s cybersecurity systems to the National Security Agency (NSA). All of the cybersecurity bills that have been proposed would provide avenues for companies to collect sensitive information on users and pass that data to the government. Trying to strike the balance between individual privacy and facilitating communication about threats is a challenge, but one thing is certain: the NSA has proven it can’t be trusted with that responsibility. The NSA’s dark history of repeated privacy violations, flouting of domestic law, and resistance to transparency makes it clear that the nation’s cybersecurity should not be in its hands.

In case you need a refresher, here’s an overview of why handing cybersecurity to the NSA would be a terrible idea:

  1. An executive order generally prohibits NSA from conducting intelligence on Americans’ domestic activities

Executive Order 12333 signed by President Reagan in 1981 (and amended a few times since1), largely prohibits the NSA from spying on domestic activities:

no foreign intelligence collection by such elements [of the Intelligence Community] may be undertaken for the purpose of acquiring information concerning the domestic activities of United States persons.
